We request that you make yourself familiar with the 6×7ART gallery sales regulations published below. You can find here basic information concerning the seller, manners of payment and delivery, principles of purchase and possible complaints. The content of the regulations is compliant with legal provisions effective on the territory of Poland, in particular with the provisions of the Act of 2 March 2000 on the protection of some of consumer rights and liability for damage inflicted by a hazardous product (Journal of Laws of 31 March 2000).

CONDITIONS OF USING THE SERVICE

The owner and operator of the online 6x7ART Gallery, hereinafter referred to as the Gallery, is the company Migavka Sp. z o.o., with the share capital amounting to PLN 50,000, entered in the Register of Entrepreneurs of the National Court Register maintained for the District Court for the Capital City of Warsaw, XIII Commercial Department of the National Court Register with KRS No 0000312703, NIP: PL1181981018, REGON 141600156. Address: Klaudyny 32c, 01-684 Warszawa; the address of the trade office (for correspondence) Gwiaździsta 71, 01-651 Warszawa, e-mail: info@6x7art.com; tel.: +48 227322701. The Office of the Gallery is open from Monday till Friday, from 9 a.m. to 5 p.m.

1. Prices given in the Gallery are gross prices – they include the VAT (if applicable) and other taxes or fees required on the territory of Poland. The given prices shall not constitute a commercial offer within the meaning of Article 66 of the Civil Code.

2. The order in the Gallery can be placed in one of the following manners:

To avoid accidental and unauthorised orders, the Gallery may verify the order telephonically or via electronic mail and where such verification turns out to be impossible, the Gallery can withdraw from its realisation altogether. Any and all obtained personal details are protected and used solely for the purpose of information for the needs of the Store in compliance with the act on personal data protection of 29 August 1997 (Journal of Laws No 133 item 883). In exceptional cases, e.g. at the order of Works of significant value or prepared for an individual order, the Gallery may request written confirmation and/or caution money and make the realisation of the order contingent on the above.

4. All orders placed in the Gallery are confirmed by the employee of the Gallery by post or via e-mail. The order is considered binding as for the price and the date of realization mentioned in the confirmation after the Customer has accepted its conditions.

We make every due effort to realise orders as soon as possible, yet the time of realisation depends on the specific character of the given Work – technology of production of the copy, availability of the Author and the manner of framing. When confirming your order, we shall give you a verified and binding time of its realisation.

10. Where the delivery is realised through a courier company – prior to collecting the parcel, one shall check the packaging to see whether or not it has been damaged during transport. In particular, one shall pay attention to the condition of tapes or seals affixed to the parcel. Should the packaging bear any traces of damage or should tapes (seals) have been destroyed, one shall refuse to collect the parcel and in the presence of the courier shall draw up a damage protocol and forthwith contact the seller in order to explain the issue. Drawing up of the damage protocol will facilitate and accelerate the settlement of possible complaint on account of damage to or breaking of the parcel during transport.

In compliance with the provisions of Act of 2 March 200 on protection of some consumer rights and liability for damage inflicted by a hazardous product (Journal of Laws of 31 March 2000),  Works purchased in the Gallery may be returned within 10 days from the date of purchase without giving reasons. This being the case, we request that you fill in the transaction withdrawal protocol and deliver the same together with the purchased item to our office. The item returned shall be complete, intact and cannot bear any traces of havening been used. The Gallery shall return the payment for the product forthwith upon verifying its condition in the same manner in which the payment for the product was made. The Gallery shall not return costs of sending or any other processing fees related to the transaction – in particular, customs and tax fees likely to occur during transport beyond the territory of the EU. The possibility of return shall apply solely to consumer transactions. Items from the secondary market, items on sales and those made or imported at an individual order of the Customer, may be excluded from the possibility of return in the manner envisaged in the provisions of the above-mentioned Act.

12. We make every due effort to present information on the website of the gallery in a reliable and up-to-date manner. However, we are unable to exclude mistakes in descriptions and specifications of Works. We shall be grateful for any comments and remarks concerning such mistakes.

13. The Gallery offers, among others, original collector’s Works of art, having the guarantee of authenticity confirmed by a relevant Certificate delivered with the Work. Works are covered by a technical guarantee concerning the appropriate technology of copy production, not shorter than two years. Details of technical guarantee are contained in technology description.

14. Orders delivered via courier mail are safely packed and insured. However, if it transpires that the purchased Work was damaged during transport, has a technical defect or is incomplete, the Gallery, if possible, will replace it with a new one, free of defects. This being the case, we request that you contact the Store directly in the Trade Office, telephonically or via e-mail in order to arrange further procedure of complaint.

15. Pursuant to Act of 29 August 1997 on personal data protection (Journal of Laws no 133 item 883, as amended), we inform that personal details you disclose shall be protected against unauthorised access. Personal data are collected only and solely for the purpose of being used by our company in order to realise submitted orders as well as streamline our services and improve their quality.
